SpotJobs provides a platform for employers, recruitment agencies, and job seekers in Australia. Employers may post job advertisements on our Site, either with or without premium placement. Job seekers can apply for these positions, but SpotJobs does not facilitate the recruitment or hiring process. The services provided by SpotJobs are solely focused on the publication of job advertisements on the Site.

2. User Responsibilities

By using SpotJobs, you agree to:

  • Comply with Australian laws, including but not limited to employment laws and non-discrimination policies.
  • Ensure that all job advertisements posted by employers are lawful and comply with applicable Australian regulations.
  • Not post any content that is illegal, misleading, discriminatory, or harmful in any way.
  • Job seekers should never be required to make any payment as part of a recruitment process. If any employer or recruiter requests payment for job placement, training, or any other reason, it is a scam. SpotJobs.com is not responsible for any financial loss or fraudulent activity related to such requests. Users are encouraged to report any suspicious activity through our contact page.

3. Posting Job Advertisements

  • Employers are required to pay for job advertisements before they are published. SpotJobs does not offer any subscription-based services; advertisements are purchased on a per-post basis.
  • Employers may select to have their job advertisements featured (with or without enhanced visibility).
  • If an agreement for regular postings is made, separate terms and conditions will apply, which will be specified at the time of agreement.
  • SpotJobs reserves the right to modify or remove any job advertisements that are in violation of these Terms or Australian laws.

4. Content Ownership

  • Employers retain ownership of their logos, job advertisements, and any other content they submit. However, SpotJobs reserves the right to modify the visual presentation of these advertisements to improve visibility.
  • SpotJobs owns all blog articles, images, and content on the Site, except where otherwise stated.

5. Modifications to Advertisements

SpotJobs may modify the format or enhance the visual presentation of job advertisements to maximize their reach, with or without notifying the employer.

6. Payment Methods

Employers can pay for advertisements via:

  • Credit Card (securely processed by Stripe)
  • Bank Transfer Payments must be completed before the advertisement is published.

7. Refunds and Disputes

  • If there is a dispute regarding a job advertisement, employers may request a refund. In such cases, the advertisement will be removed from the Site, and the refund will be processed.
  • For all other disputes, the applicable jurisdiction is the courts of Nanterre, France.
  • SpotJobs is not responsible for any disputes arising between employers and job seekers or recruiters related to recruitment decisions, job offers, or contract enforcement.

8. Liability Exclusion

SpotJobs is not responsible for:

  • Interruptions to service, technical issues, or downtime, including issues caused by hacking, data breaches, or system failures.
  • The recruitment process or outcomes following an application submitted via the Site.
  • Any unpaid dues or infractions by employers in the execution of employment contracts.

9. User Exclusion and Account Termination

SpotJobs may terminate or suspend any user’s account for violation of these Terms. Users may request account closure or termination of job alerts at any time.

10. Legal Compliance

  • Employers are responsible for ensuring that their job advertisements do not violate Australian laws or regulations.
  • SpotJobs reserves the right to moderate and remove any advertisements that do not comply with Australian laws.

In the event of any dispute regarding job advertisements, SpotJobs will issue a refund, provided the advertisement is removed from the Site. For all other disputes, the jurisdiction is in the courts of Nanterre, France.

13. Account Data Deletion

Users may request the deletion of their accounts and personal data at any time. Any job alerts will also be terminated upon request.

14. Platform Usage

The Site is intended for use only within Australia. Job advertisements posted outside of Australia are prohibited.

15. No Warranty

SpotJobs provides the Site and services “as is” and without any warranty, express or implied, including but not limited to fitness for a particular purpose or non-infringement of third-party rights.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any legal action or proceeding relating to these Terms shall be exclusively brought in the courts of Nanterre, France.
